1) Acceptance of Terms
By accessing or using instavido.com (“InstaVido”, “we”, “us”, “Service”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, you must not use the Service.
2) Service Description (No Affiliation)
The Service provides tools that, upon your request, attempt to fetch publicly available media from Instagram URLs that you supply. We are not affiliated with Instagram or Meta Platforms, Inc. “Instagram” is a trademark of its respective owner. Availability and features may change without notice.
3) Eligibility & Account Responsibility
You must be at least 13 years old, or the age of digital consent in your jurisdiction, to use the Service. Where applicable, you represent that you have legal capacity to enter into these Terms.
4) Your Responsibilities
- You are solely responsible for the URLs and content you submit and the way you use the outputs.
- You must comply with all applicable laws and third‑party terms (including Instagram’s terms, copyright and privacy laws).
- Do not use the Service to access or download content that you are not legally entitled to access (e.g., private/restricted content).
- Do not use the Service for any unlawful, infringing, harmful, harassing, deceptive, or abusive activity.
5) Prohibited Conduct
- No reverse engineering, data scraping at scale, automated high‑frequency requests, or bypassing rate limits or technical protections on our Service or on Instagram.
- No interference with the Service’s operation (e.g., injecting malware, DDoS, exploiting vulnerabilities).
- No use of the Service to violate third‑party intellectual property, privacy, or publicity rights.
6) Intellectual Property
The Service (including code, UI, design, and brand elements) is owned by InstaVido or its licensors and is protected by applicable IP laws. No rights are granted to you except as expressly set out in these Terms.
7) User Content & License
To operate the Service, you grant InstaVido a limited, non‑exclusive, worldwide, royalty‑free license to process the URLs and related technical information you submit solely to provide the Service to you. We do not claim ownership over media hosted by third parties (e.g., Instagram).
8) Privacy & Data Protection
We aim to minimize personal data processing. See our Privacy Policy for details on what we collect, how we use it, and your rights. If you are in the EEA/UK, we process personal data according to GDPR principles where applicable. If you are a California resident, you may have rights under the CCPA/CPRA.
- We do not knowingly store your download history for profiling purposes.
- We may retain limited operational logs (e.g., error logs, rate‑limit counters) to secure and operate the Service.
- We may use cookies or similar technologies to improve the experience; see our Cookie Policy where applicable.
9) Third‑Party Services
The Service may reference or interact with third‑party platforms (e.g., Instagram). We do not control and are not responsible for third‑party services, their content, or availability. Your use of them is governed by their terms.
10) Copyright Complaints (DMCA‑Style)
We respect intellectual property rights. If you believe a URL processed through our Service makes infringing content accessible, send a notice including:
- Your name, company (if any), address, email, phone;
- Identification of the copyrighted work claimed to be infringed;
- Identification of the allegedly infringing material or URL(s) for removal/disablement;
- A good‑faith statement that the use is unauthorized by the rightsholder, agent, or law;
- A statement that the notice is accurate and, under penalty of perjury (where applicable), that you are authorized to act for the rightsholder;
- Your physical or electronic signature.

Counter‑Notice: If you believe a removal was erroneous, you may submit a counter‑notice with sufficient details and your consent to jurisdiction for resolution. We may restore access at our discretion and/or as required by law.
Repeat Infringers: We may block users subject to repeated or egregious infringement claims.
11) Availability, Changes & Suspension
We may modify, suspend, or discontinue any feature or the entire Service at any time, with or without notice. We may throttle or block activity that, in our reasonable opinion, risks stability, security, or compliance.
12) Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including accuracy, availability, non‑infringement, merchantability, or fitness for a particular purpose. Your use is at your sole risk.
13) Limitation of Liability
To the maximum extent permitted by law, InstaVido and its affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or any loss of profits, data, goodwill, or reputation, arising out of or relating to your use of the Service. Where liability cannot be excluded, it will be limited to the greater of (a) the amount you paid us in the 12 months before the claim (typically zero), or (b) USD 100.
14) Indemnification
You agree to defend, indemnify, and hold harmless InstaVido, its affiliates, and personnel from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or infringement of any third‑party rights.
15) Export Controls & Sanctions
You represent that you are not located in, under control of, or a national or resident of any country or entity subject to applicable trade sanctions or export controls. You agree not to use the Service in violation of such laws.
16) Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you violated these Terms or applicable law, or to protect the Service and users.
17) Governing Law & Jurisdiction (Neutral)
These Terms and any non‑contractual obligations arising out of or in connection with them are governed by the laws of England and Wales, without regard to conflict‑of‑laws principles. The courts of England and Wales shall have exclusive jurisdiction. If you are a consumer in the EEA/UK, any mandatory consumer protections in your home country remain unaffected.
18) Severability; Entire Agreement; No Waiver
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force. These Terms constitute the entire agreement between you and InstaVido regarding the Service, and supersede any prior understandings. Failure to enforce any provision is not a waiver.
19) Changes to These Terms
We may update these Terms from time to time. Changes are effective when posted. Your continued use after changes constitutes acceptance.
